Refund and Cancellation Policy

This policy applies to everything you buy from Upar Utho Workspace and forms part of our Terms of Service. We would rather be plain about it up front than argue about it later.

1. Why fees are paid in advance

What you buy is the right to use an address for a fixed term. Once a term begins the address is committed to you, your name goes on our nameboard, and the address becomes available for your statutory filings. Our cost is incurred at the start of the term and we cannot recover it afterwards.

So fees are payable in advance and, except as set out below, are not refundable.

2. If you cancel before we issue any documents

If you cancel in writing to kbharti95@gmail.com before we have issued your no-objection certificate, address proof letter or any other document in your set, and before your name has gone on the nameboard, we refund the fee you paid, less an administrative charge of Rs. 500 and less any tax we have already paid to the exchequer.

This ends three days after your payment, or the moment we issue any document in your set, whichever comes first.

3. After we issue your documents

Once any document in your set has been issued, the fee for that term is not refundable, whether or not you go on to use the address.

That applies whether you cancel by choice or because you decided not to proceed with the incorporation or registration you had planned.

4. If an authority rejects your application

We do not guarantee the outcome of any application. A rejected incorporation, GST registration or other approval does not by itself entitle you to a refund.

But if an application is rejected solely and demonstrably because of a defect in the documents we gave you, or solely because we failed to open the premises for a scheduled verification, we will either fix the defect and support a fresh application at no further fee, or refund the fee for that term — our choice.

Claim within fifteen days of the rejection order, in writing, with a copy of the order.

5. If you cancel part-way through a term

You may end your engagement on thirty days' written notice. We do not refund the fee for the unexpired part of the term.

If you took an annual term and cancel after the sixth month, there is no refund. If you cancel within the first six months and no document in your set has been used for any statutory filing, we may at our discretion refund a pro-rated share of the remaining months, less the administrative charge.

6. If we end the engagement because of you

If we end it for non-payment, for breach of the Terms of Service or the Acceptable Use Policy, for failure to give or update your documents, or because we reasonably believe the address is being used unlawfully, there is no refund and the security deposit is forfeited.

7. The security deposit

The deposit is separate from the fee. It is interest-free and refundable.

We refund it within thirty days of you showing us that you have changed your registered office and place of business with every authority that held our address, and taken our address off your letterheads, invoices, website, marketing material and public records.

We deduct anything you owe us — arrears of fee, interest on late payment, charges for extra services. If you do not change your address within thirty days of the engagement ending, the deposit is forfeited.

8. Duplicate or wrong payments

A duplicate or obviously mistaken payment is refunded in full within fourteen working days of it being brought to our notice and verified.

9. How refunds are paid

Approved refunds go by bank transfer to the same account the original payment came from, and to no other account. We process them within fourteen working days of approval. How long your bank then takes is outside our control.

Tax we have already paid to the exchequer is refundable only to the extent we can recover or adjust it under the law.

10. How to ask for a refund

Write to kbharti95@gmail.com from the email address registered with us, with your name, agreement reference, invoice number, payment reference, why you are asking, and any supporting documents. We acknowledge within three working days and give you our decision within fifteen working days.

11. Grievances
