Privacy Policy
This policy explains how Upar Utho Workspace, a sole proprietorship of Kanhaiya Bharti, handles personal information in connection with this website and the registered address services provided through it. It is published under the Information Technology Act, 2000, the rules made under it in 2011, and the Digital Personal Data Protection Act, 2023.
1. What we collect
- Enquiry details — your name, business name, mobile number, email, city and what you told us, whether sent through this website, by phone, email or WhatsApp.
- Due diligence documents — PAN of the entity and of each director, partner or proprietor; Aadhaar of the authorised signatory; certificate of incorporation, LLP agreement or partnership deed; board resolution or authority letter; a photograph of the signatory; your alternate operating address with proof; contact details; and a description of your business.
- Transaction records — amounts, dates, payment references, bank details shown on remittances, invoices and receipts.
- Service records — mail and couriers received for you, visits to the premises, correspondence with us, and records of any statutory verification visit concerning you.
- Website data — IP address, browser and device type, pages visited and time of visit, collected through server logs and, where used, cookies and analytics.
2. Why we process it
- To answer your enquiry and quote for the service.
- To carry out due diligence and satisfy ourselves that the address will be put to lawful use.
- To provide, administer, invoice and support the service, including mail handling and issuing your document set.
- To meet our own obligations under tax, companies and GST law.
- To respond to lawful requisitions, notices, summons and investigations by authorities.
- To establish, exercise or defend legal claims.
- To improve this website and the service.
3. Consent
We process your information on the basis of the consent you give when you send an enquiry or sign an agreement, and on the basis of our need to comply with the law and to defend legal claims.
You may withdraw consent at any time by writing to us. Withdrawing consent for information we need to provide the service or to meet statutory obligations means we must stop serving you. It does not undo processing already carried out, nor our retention obligations in section 6.
4. Aadhaar and identity documents
Where we collect Aadhaar it is solely to verify the identity of your authorised signatory. We do not authenticate Aadhaar through UIDAI, we do not store biometric data, and we do not publish Aadhaar numbers.
You may give us a masked Aadhaar showing only the last four digits where the authority you are filing with accepts it.
5. Who we share it with
We do not sell, rent or trade your information.
- Statutory, regulatory, investigative or judicial authorities, on lawful requisition — without telling you first where the law prohibits us from doing so.
- The owner of the premises, only as far as needed to arrange a verification visit or obtain a no-objection certificate or address proof.
- Our professional advisers, under confidentiality.
- Payment processors, banks and IT service providers, only as far as needed to run the business.
6. How long we keep it
We keep your records for at least eight years after your engagement ends, or longer if the law or a pending proceeding, investigation or claim requires it.
This reflects the record-keeping the law requires of us and the real possibility that an authority asks about an entity that was once registered at our address.
7. Security
We keep reasonable security practices proportionate to what we hold — restricted access to physical and electronic records, password protection, and confidentiality obligations on anyone handling client records.
No method of storage or transmission is completely secure and we cannot promise absolute security. You are responsible for the security of the devices and accounts you use to reach us.
8. Your rights
You may ask for access to the information we hold about you, ask us to correct an error, ask for erasure, or raise a grievance, by writing to the contact in section 11. We respond within thirty days. We give effect to erasure requests except where section 6 or the law requires us to retain.
9. Cookies
This website may use cookies and similar technology to work properly and to understand how it is used. You can disable cookies in your browser, though some features may then not work. Where we use a third-party analytics service, that service's own privacy policy governs what it does.
10. Children
Our services are not aimed at anyone under eighteen and we do not knowingly collect their information.
